Care system against Berlin lawyer: public prosecutor's office is aiming for a ban on a profession

Lawyer in Berlin charged with fraud

The Berlin public prosecutor has charged a lawyer for fraud and is aiming for a ban on a job. The 56-year-old lawyer is accused of wrongly billing his client more than 230,000 euros. The indictment comprises 25 cases of commercial fraud that were committed from December 2017 to August 2022.

The lawyer specializes in inheritance law and continues to practice in Berlin-Schöneberg. According to the public prosecutor, he asked his clients to pay excessive fees without actually wanting to take over the cases. In order to disguise his intentions, he is said to have hidden his agreements in the "small print" and pushed clients for signature under time pressure. He is said to have covered passages on the form by hand and spoke of "lawyer stuff" to avoid inquiries. Although the chamber court had informed him that this clause was inadmissible, he retained it.

The lawyer also accused the lawyer of having demanded high payments quickly by new clients so that they canceled the mandate indignantly. If fees have not been paid, he is said to have commissioned colleagues to sue them. He is also said to have deleted bad ratings on the Internet promptly.

The public prosecutor looks at the case as a serious fraud and therefore strives for a ban on profession for the lawyer. The accused now has to answer in court.
