A positive decision for pharmaceutical services in Berlin

The drama for the pharmaceutical services has reached its turning point today! In a highly expected judgment, the State Social Court of Berlin-Brandenburg rejected two lawsuits against decisions from the arbitration board. A victory for all patients, because the existing conditions for the pharmaceutical services remain unchanged!

dr. Hans-Peter Hubmann, the chairman of the German Pharmacist Association, cheered: "These are good news!" A clear expression of the relief, because the arbitration saying guarantees that the pharmaceutical services will continue to be fully provided for the insured. These services not only improve safety when taking pharmaceuticals, but also significantly increase the effectiveness of drug therapy.

What is behind this important judgment? The pharmaceutical services were determined by the on-site pharmacy strengthening law (VOASG) in §129 paragraph 5e SGB V. The arbitration board made a decisive decision as early as May 2022 after the negotiating partners were unable to reach a mutual result.

But that wasn't all! The conflict found its way through a lawsuit by the GKV top association in July, followed by another lawsuit by the Hesse Association of Statutory Health Insurance Physicians in August 2022. The German Pharmacists' Association was involved in both procedures and was at the side as a party.

The decision of the court is not only a victory for the pharmacists, but also an important confirmation of the pharmaceutical services as an indispensable part of health care. Thanks to this regulation, pharmacies can continue to offer their valuable services in order to improve the drug therapy of patients. A real gain for health!
