Last year, 58 innocent people in Berlin had to spend a total of 4,803 days behind bars. The detention times varied significantly: While a few 13 days were custody, others had to sit up to 231 days. Those affected receive a compensation of 75 euros per day in prison, a nationwide uniform regulation.
In 2022, 35 people were compensated for a total of 2,624 days, in 2021 there were 54 people for 6,936 days. The judicial authority makes it clear that the payment of compensation does not necessarily indicate the illegality of the detention measures. Compensation can be due even if the conviction, especially if the pre -trial detention takes longer than the final sentence. In addition, in 2023 there were payments of around 39,364 euros for attorney costs or confiscated items, such as n-tv.de reported. The amounts of the compensation ranged from almost 50 to 21,265 euros.
