Berlin court forces Federal Government to divide a visa for Afghans!
In an important decision, the Berlin Administrative Court today decided that the German federal government must issue an Afghan and its 13 family -related visas to enter Germany. The judges justified their decision with the government's existing legal obligations, which result from non -revoked admission evaluations. This decision was made as part of an urgent procedure for the Federal Recording Program for endangered Afghans. The Saleh family, who currently lives in Pakistan, waited in vain for the Visa and is now afraid to deport them to Afghanistan, where their lives are threatened under the Taliban rule. According to RBB24, the argument of the applicants that they could be entitled to the visas and could no longer remain in Pakistan, on the decision of the court. The Federal Office for Migration and Refugees had already granted the family an admission of admission in October 2023. Nevertheless, the German embassy in Islamabad refused to issue the desired visa. This problem highlights the current challenges and legal dilemmata, with which endangered Afghans are faced. According to the Tagesschau, the Federal Government is obliged to react immediately to the decision of the court, but can file a complaint with the Higher Administrative Court of Berlin-Brandenburg, which could cause additional delays.
legal Situation and future perspectives
The judges of the Berlin Administrative Court made it clear that the government has legally committed to admission and that this cannot simply be announced. This bond also exists because the family's urgent application was successful in the first instance. However, through its current political decisions, in particular with regard to the voluntary admission program, the Federal Government has to change the framework conditions or also end the entire procedure, as ZDF.
In autumn 2022, the government initiated a program for the recording of particularly endangered Afghans that have campaigned for equality and democracy. Nevertheless, around 2,400 people in Pakistan currently see themselves in an insecure location and are waiting for Visa. The organization "Kabul Luftbrücke" plans to legally enforce the continuation of the recording program. At the moment there are around 40 other urgent requests and complaints that show how pressing the situation is for many of these people.
The decision of the Administrative Court is a significant step, but the uncertainty regarding the further procedure of the Federal Government remains. It remains to be seen what effects this decision will have on the ongoing procedures and the support of other Afghans in similar situations.
