79-year-old races in front of the police-forbidden races in Schmöckwitz!

Schmöckwitz, Deutschland - On June 23, 2025, a 79-year-old man fled with a motorcycle in front of the police in Schmöckwitz after exceeding the permissible top speed during speed measurements on the eagle frame towards Grünau. At 12:25 p.m., the motorcyclist ignored a police officer and accelerated strongly. His escape led him towards water sports, where he overtook several vehicles and thus forced oncoming traffic to brake. At a narrow point, the attempt to flee through a forest path finally failed and the police could stop him.

During the persecution, the driver not only endangered other road users, but also cyclists when he turned left at Kablower. The police secured the driver's license and the man's motorcycle. Because of his behavior, the 79-year-old must now be responsible for a forbidden motor vehicle race. A specialist commissioner of Police Directorate 3 (East) has taken over the further investigation. This situation also throws a light on the legal framework in Germany, especially with regard to § 315d StGB.

legal situation and traffic safety

According to a decision by the Stuttgart Higher Regional Court, police flight is considered comparable to a race, which means that the requirements for criminal liability according to Section 315d (1) no. 3 of the Criminal Code are met. The justification for the law indicates that not only the intention to achieve the highest possible speed is considered, but also the subjective feeling and the traffic situation. The legislator has intentionally waived the word "alone", which allows a broader interpretation of intention, even in cases of police flight.

The long -term strategy of the EU to create a European area for road traffic safety since 2010 requires additional measures to improve security on the streets. This initiative aims to reduce the number of traffic fatalities to zero by 2050. In 2021, the number of traffic fatalities in the EU rose by 6 % compared to the previous year, which requires urgent action to improve security. The EU has already taken a number of initiatives to achieve these goals, including new guidelines for improving traffic safety and regulations for alcohol -related driving offices.

The events in Schmöckwitz illustrate how important it is to take traffic safety seriously. Such incidents are not only dangerous for the people at the scene of the accident, but also represent a violation of the rules that the EU, represented by various legislative initiatives. In addition to the legal punishment, the clarification and prevention is also crucial to make road traffic more secure.
