The applicant who was born in 2000 and applied to the police in 2022 had an anti -constitutional images on his cell phone as part of a hired investigation. In several chat history, images with anti -constitutional symbols were discovered, which he received and forwarded. The first two photos showed Adolf Hitler, the third a man with a black skin color who wore a T-shirt with a swastika.

Because of this behavior, the police rejected the application against which the man complained to the administrative court. The court now dismissed the lawsuit and argued that the authority was "allowed to deny the plaintiff's suitability for the police profession because of the multiple sentence without a comment. The applicant did not show that he reflected on his misconduct, recognized the injustice or have drawn conclusions for the future.

The court emphasized that police officers had to meet particularly high demands regarding their character stability. They would have to work for the free democratic basic order at any time and pay attention to and protect people of all origin regardless of their religion. It is irrelevant whether sending the images is relevant under criminal law. Approach to the Higher Administrative Court of Berlin-Brandenburg is possible against the judgment that was made at the end of June.
