Judgment judged: administrator must repay 26,400 euros to the community of owners

A financial scandal draws tremendous waves through the owner community in Berlin! An administrator who held the scepter in his hand for a long time made a shocking decision before his dismissal: he transferred himself a whopping 26,400 euros from the account of the apartment owner community (WEG) without being asked and in advance. The shock sits deeply, because the community finally wanted to recall it on 24th of the month, only at a week later on the 31st to decide on the final end of the termination without notice.

The administrator claimed brazenly that the money would be entitled to a basic remuneration, but the due time for this payment would only have been the first of the coming month. Who doesn't think about unchecked greed? However, the community of owners did not simply be ripped off and complained of the repayment of the ripped -off amount. And the judiciary gave her right!

court confirmed: proven to be infidelized!

The Cologne District Court made a shocking judgment: unfaithful! The judges agreed that the administrator had not only acted against the rules, but also illegally reached. Of course, he did not help say that the money would have been due after the termination. Even the fact that he may have open claims does not entitle him to easily use himself!

This case shows once again how important a transparent administration is within the way. At a time when trust and honesty are the most in demand, something like this must not happen. The community of owners not only got their money back, but also set an important sign: the right of payment is not undermined!
