Berlin: Employees of central property protection receive retroactive salary after judgment of the Federal Labor Court

The Berlin police in the central property protection receives a significant increase in salary retrospectively and is classified in a higher salary level. This information was confirmed by the Senate Administration to the Tagesspiegel. The Federal Labor Court decided according to several lawsuits that the employees had to be paid appropriately for property protection, since their activity requires thorough specialist knowledge.

According to the federal states' collective agreement, employees should be paid according to level E5. This corresponds to a monthly content of gross 2618 to 3230 euros, depending on age. So far, only 439 of the 1600 employees have been paid according to E5, but most of them according to E4 with a gross salary of 2500 to 3098 euros a month. The classification in E4 is actually intended for unskilled employees without training. The written judgment of the Federal Labor Court arrived in Berlin in April and the interior administration stated at the end of May that the possible consequences of the judgment still have to be examined.

Now the financial and interior administration have found a way to implement the judgment. As a precaution, funds were discontinued in the budget draft for the years 2024 and 2025, as the interior administration announced. Interior Senator Iris Spranger (SPD) supports the higher grouping of the tariff employees in the central property protection and emphasizes the importance of the work of the object supporters.

The number of positions in the police protection of the police has risen slightly. In 2021 there were 1523 jobs, while in 2023 it was already 1606. Nevertheless, the number of monitored objects has decreased, which is related to the decline in mobile surveillance. In January 2021, 1188 objects were still monitored, while in May 2023 there were only 1013.

The Berlin police are currently working on solutions to carry out the necessary re -calculations. All tariff employees in central property protection are classified in accordance with the judgment. The amount of the additional payments is currently being determined. The financial management expects additional costs of 4.7 million euros per year. The first steps for additional payment have already been taken, in which three employees received a total of 12,649.78 euros for four years. Manual annual recalctions are necessary for the years before. For around 90 employees who have been suing for a higher salary level for more than ten years, significantly more than 10,000 euros are expected, said plaintiff lawyer Johannes Weberling compared to Rbb.

It remains to be seen how the judgment is implemented and what other consequences result. The work of the object supporters is appreciated by the higher payment and classification into a higher salary level.
