gutted climate protection policy: German environmental aid is again fighting in court for climate protection

The German Environmental Aid (DUH) and eleven young people jointly submit constitutional complaint against the polluted climate protection law of the Federal Government. The environmental and consumer protection organization has also submitted another climate lawsuit about the late publication of the climate protection report. The report is an important instrument for the control of the Climate Protection Act and documents the progress of the climate protection programs.

Jürgen Resch, the DUH federal manager, criticizes the government and emphasizes that fossil energy and car companies hinder an effective climate policy in Germany and endanger the future of the next generations. In particular, the promotion of luxury off-road vehicles with combustion engines shows the lack of government commitment to climate protection. Barbara Metz, Duh federal manager, indicates that the building area has already missed the climate goals three times and that greater the climate protection law would further worsen this situation.

The federal government violates both the old and the new climate protection law. The government's central climate protection program is not sufficient to reach the prescribed climate target by 2030. The DUH has already gained several climate lawsuits against the federal government in court. With the lawsuit against the late publication of the climate protection report, the DUH now submits its sixth complaint based on the Climate Protection Act.

The change in the climate protection law is classified by the DUH as unconstitutional. The most important changes serve the goal of no longer having to decide on any further climate protection measures by 2030. This will have to be much strictly more strictly in order to achieve the climate goals. The DUH therefore submitted a constitutional complaint and has further complaints against the federal government.

The Duh constitutional complaint is one of three symptoms submitted by five German environmental associations. As early as 2021, the Federal Constitutional Court granted the right to climate protection.

background:

The Duh constitutional complaint is part of a joint action by five German environmental associations that act against the inadequate climate policy of the federal government. In addition to the DUH, Greenpeace, Germanwatch, the BUND for the Environment and Nature Conservation Germany (BUND) and the Solarenergie Förderverein Germany (SFV) also raise a complaint.
