Revolution in sex work law: self -written draft for equality!

Berlin, Deutschland - On June 2, 2025, sex workers presented a ground -proof draft law on the reform of sex work law in Berlin. This initiative is the first comprehensive legislative measure in Germany, which was written by sex workers. The presentation of the design took place in the Berlin twelve Apostle Church and marked the international day of sex workers, which is reminiscent of the holding of the Saint Nicer Church in Lyon in 1975, where sex workers protested for their rights. Among other things, the activists call for the abolition of the registration obligation, the possibility of anonymous registration as a self -employed and the inclusion of the artist social insurance (KSK) in health care for sex workers.

The draft entitled "Law for Equality, Respect and Rights in Sex Work" includes over 60 paragraphs, which include the rights of sex workers and regulations for traders, customers, authorities and advice centers. The development of the draft extended over several months between November 2024 and April 2025. This initiative comes against the background of the critical evaluation process of the prostitute protection law (ProstschG) of 2017, which many perceive many as stressful and bureaucratic. The Prostschg has lifted the immorality of sex work, but also created new hurdles for sex workers who are still being discussed today.

The ver.di Federal Rauenrat is also committed to improving the working conditions of sex workers and criticizes that the legal situation in Germany is contradictory. Rarely can sex workers in Germany access safe jobs, since many are active in the informal sector, which makes them more susceptible to exploitation and violence. The members of the Federal Women's Council reject the criminalization of self -determined sex work and warn that a ban on buying sex could lead to a dangerous impression of sex work underground, which is raising the risks.

It is all the more important that the regulations for sex workers take into account the different realities of life. Discrimination due to gender, sexual orientation or racism often affects relatives of marginalized groups such as migrants or LGBTQI* people. In the current debate, it is essential to consider the variety of life situations of sex workers in order to reduce stigmatization and disadvantage. The Federal Constitutional Court protects the exercise of sex work under professional freedom and sexual right of self -determination, which is a central challenge for regulation.

outlook and future developments

In view of the evaluation of the prostitute protection law until July 2025, the alliance of sex workers hopes that their draft is incorporated into the parliamentary debate. In Berlin, various discussions, film screenings and workshops on the topics of rights and working conditions of sex workers are also planned in Berlin. While the legislative framework remains controversial, the demand for better social security, health care and labor law support becomes loud.

The current developments and the increasing voices from various organizations, such as the German Women's Council, the German Lawyers' Association, Aidshilfe and Amnesty International, lead to an intensive examination of the rights and needs of sex workers in Germany. The challenge remains to create a legal framework that enables protection against exploitation and violence, while at the same time promoting the self -determination and safety of sex workers.
