Pankower Ordnungsamt caught advertising hardeners

The Pankower Ordnungsamt recently caught a person who has attached advertising to parked cars without permission. This represents an administrative offense that can be punished with a fine of up to 10,000 euros. The distribution of advertising maps on parked cars represents a distribution of advertising material on streets within the meaning of Section 8 (2) of the Road Cleaning Act. According to the "Zero-Watste-Strategy" of the State of Berlin, it is important to consistently expand waste avoidance and to reuse the raw materials used for the production of products. The distributed advertising species do not correspond to this guiding principle, since they cannot be attributed to the paper material cycle and also regularly contaminate public space.

The unauthorized distribution of advertising types to motor vehicles is not only limited to the Pankow district, but also represents a phenomenon to be observed across Berlin. The associated contamination of public space leads to numerous symptoms from the population and also regularly employs the responsible authorities. On January 11th of this year, the services of the General Ordnung Service (AOD) managed to attack a male person in Kissingenstrasse, which brought the corresponding advertising hardware to buy motor vehicles on the passenger car parked there, without being able to show for this. In particular, the placement of advertising types on parked cars represents a distribution of advertising material that is subject to a permit on streets within the meaning of Section 8 (2) of the Road Cleaning Act. Such permission should generally only be granted if the organizer is obliged to have the expected contamination of the streets remedied or eliminated. In the absence of the relevant applications or declarations of commitment by "organizers", the necessary permits are generally not granted.

The Pankow regulatory office reserves the right to include test sales in the future in order to be able to fully account for the actual causes. In particular, the determination of corresponding violations is very complex in practice, since the crime must be observed in individual cases on site. People who are found in the distribution of corresponding advertising hardware are rarely able to name those responsible. Investigations solely based on the telephone numbers printed on the advertising hardware have proven to be very expedient in the past, since almost exclusively anonymous prepaid connections are used that responsible traders do not reveal.
