New regulation in the middle: bargain for spatis allowed again

The district councilor for order, environment, nature, streets and green spaces, Dr. Almut Neumann, today, on April 16, 2024, announced that taps for so -called lateis will be allowed again under certain conditions in the Mitte district. Since May 2022, the Spätis in Mitte has been prohibited from operating the gardens, but at the request of the district assembly in Mitte, this regulation has now been loosened.

So far, taps in front of mixed companies such as bakeries, butchers and delicatessen shops have been allowed. What is new, however, is that “Spätis”, which have certain similarities with supermarkets, can now operate a bar front garden under certain conditions. This requires a corresponding restaurant permit and a special usage permit. During the day, the operation is permitted from 6 a.m. to 10 p.m., while a nightly operation is only possible with a noise report and possibly an immission law permit.

The district administration will monitor the effects of this new regulation and make an assessment after one year. If a spati leads to a harassment of the residents, the approval for the Schankvorgarten can be withdrawn.

This decision of the district office could have both positive and negative effects on the local environment. While the Spätis benefit from this loosening and can offer their customers a more pleasant atmosphere, residents could possibly be bothered by noise and disorders. It will be crucial how the companies and the district administration deal with these potential problems.
