Berlin - The Justice Senator Felor Badenberg (independent, CDU) defends itself to classify the “Last Generation” group as a criminal association. However, their reasoning is not convincing and could be interpreted as a trivialization of the crimes committed, according to Gunnar Schupelius.

Badenberg commissioned their authority to check the “last generation” climate activists, since it believes that their activities significantly impair life and everyday life in Berlin and sometimes even endanger. The examination process was completed unusually quickly and Badenberg presented a 30-page assessment last week.

According to the result of the examination, it is only a criminal association if the group arises "a significant risk to public security". Examples of this include drug rings and violent neo -Nazi groups. Accordingly, the "last generation" is not classified as a criminal association.

This reason is not convincing, however, since the Criminal Code (§ 129) defines a criminal association as a group that "whose purpose or activity is aimed at committing crimes". This is exactly what applies to the members of the “last generation” who have organized themselves to constantly commit crimes. There is no requirement for the severity of the crimes committed, but in principle because crimes are planned and prepared.

Therefore, the judiciary could have come to the conclusion that the climate adhesives are very well a criminal association. If this were recognized, other and harder punishment would be possible. Anyone who founds a criminal association or belongs as a member must expect a prison sentence of up to five years. Supporters threaten up to three years of deprivation. Thus, the hustle and bustle of the climate activists could be put to an end.

Badenberg is seen as a committed lawyer who previously worked as Vice President of the Federal Office for the Protection of the Constitution. She made sure that the AfD was classified as a "right -wing extremist suspicion" in March 2022. Before her swearing -in as a senator three months ago, she emphasized that she clearly distinguishes herself against right -wing extremists.

was hoped that it also shows the same clarity compared to left -wing extremists, such as those of the climate activists. Unfortunately, this does not seem to be the case, as the Berlin FDP state chairman Christoph Meyer notes: "The Berlin Senate remains blind in the left eye."
