Senate under pressure: District office calls for legal clarity for fee workers in schools
The district office Reinickendorf calls on the Berlin Senate to create legal framework conditions in order to ensure the employment of fee forces at adult education centers, music schools and youth art schools. According to the so-called "Herrenberg judgment" of the Federal Social Court and the then adapted guidelines, freelance teachers who carry out orders for these schools are actually only "self-employed". This prompted the district offices to ask the Senate several times to clarify.
District Mayor Emine Demirbüken-Wegner emphasizes the urgency of a quick solution, since many committed teachers see their existence threatened and important integration and language courses for refugees are at stake. At the moment, the fee contracts in Reinickendorf continue to exist, but status assessment procedures are being prepared for each individual contract. New contracts can only be concluded if the Senate ensures corresponding legal certainty.
There is a fear of considerable risks regarding criminal liability and the obligation to recourse for employees who sign fee contracts. The examination of the contracts therefore serves to protect employees within the framework of the duty of care.
In Berlin and other German cities, the employment of fee forces at adult education centers and other institutions has been the focus for a long time. The uncertainty regarding the independence of these teachers ensures uncertainty and obstacles to hiring new forces. A clear legal regulation by the Senate is therefore urgently needed to ensure the continuous implementation of educational offers.
