Federal Constitutional Court: A sign against extremism
In a significant step towards strengthening the constitutional order of the Federal Republic, the factions of the SPD, the Greens and FDP have agreed with the Union to reform. The aim is to better protect the Federal Constitutional Court (BVerfG) against extremist ideas. This initiative will be presented in Berlin in a press conference next Tuesday, made possible by the association of the Federal Press Conference, in which Federal Minister of Justice Marco Buschmann will also take part.
adjustments in the Basic Law
The reform is the result of considerable concern about the possible emergence of extremist parties. In the run-up to the negotiations, the traffic light coalition had suggested last year to not capture the regulations on the election and term of office of the constitutional judges in a simple law, but to integrate them into the Basic Law. This is of central importance, since a two-thirds majority is required for such changes in the Bundestag. The support of the Union faction is therefore essential, which underlines the bipartisan character of this project.
teaching from Poland
The advisory services not only addressed the resilience of the Federal Constitutional Court, but also experiences from other countries, especially Poland, were used. The national conservative government there, which was in power from 2015 to 2023, had significantly rebuilt the judicial system. A central point was the non -recognition of three constitutional judges who were appointed before taking office, followed by the occupation of these posts with their own candidates. These events illustrate how political extremism and the judicial system can get into conflict.
role of the public
The upcoming reform has the potential to not only strengthen the independence of the Federal Constitutional Court, but also to promote the trust of citizens in the rule of law. The protection of the constitution and the integrity of the highest court are fundamental to democracy in Germany and can make a decisive contribution to the stability of society. The participation and education of the public about these reforms are also of great importance in order to create a broad understanding of the challenges and measures that are necessary to maintain democratic values.
a preventive approach
With these changes, a preventive approach is to be followed, which aims to maintain the resilience of the Federal Constitutional Court and to strengthen democratic institutions. It is a way that is intended to raise awareness of the protective mechanisms in German democracy and sends a clear message to extremists: the basic values of the Federal Republic of Germany are defended.- Nag
