The District Court of Tiergarten had to deal with the case of Mariam R. again. The 64-year-old woman has been on trial regularly for over 40 years and was convicted of various offenses such as theft, insult and fraud. Mariam R. has obvious connections to the clan-milieu.
In the current case, it was about the accusation of social fraud. In court, the accused said that she had been widowed since her husband's death and had to live on a widow's pension of less than 500 euros. She complained that the state would not leave her alone. In addition, she currently paid a fine in 50-euro rates. Mariam R. was accompanied by one of her sons during the process and cried a lot.
The indictment accused the Lebanese national to have received services under the Asylum Seekers Benefit Act since he was entered in 1981. In her last application, however, she lied by specifying not to have any factual values of special value. But since 2017 it has had jewelry worth a total of 36,430 euros, including seven bracelets, three pairs of earrings and a royal chain worth 2100 euros.
In addition, Mariam R. received cash, from which she had not communicated anything to the Spandau social welfare office. The amount of 12,000 euros came from a rental cancellation agreement after a fire in Schöneberg in autumn 2018. At that time, media reports were spoken of a "clan apartment" that burned down.
Overall, the woman moved illegally between July 2017 and the end of 2018. Since January 2019, she no longer receives payments. In addition to these allegations, further crimes were committed against them, which is why they were sentenced to eleven months in prison last March.
In the current process, there was an understanding between the court, the public prosecutor and defense. In the event of a confession, Mariam R. would again receive a suspended sentence. Finally, the accused admitted the allegations and apologized. She claimed that she had no jewelry.
The investigation and the procedure were triggered by the jewelry that Mariam R. had reported after the apartment fire in Kantstrasse in an insurance company as a loss of around 120,000 euros. The court has now sentenced them to a prison sentence of one year and seven months on probation for fraud in 24 cases. In addition, the collection of the 21,165 euros was ordered.
