District court tilts construction fees: fees could increase!
Four counties in Brandenburg won a decisive victory before the Berlin-Brandenburg Higher Administrative Court. The judges said that the state's organization fee regulations violate the state constitution, since they do not sufficiently cover the actual costs that arise from the municipalities through transferred tasks. The court found that the country had to create a precise cost forecast, which obviously did not happen - for example, the increasing personnel costs were not taken into account.
The consequence of this decision is clear: the construction fee schedule must now be fundamentally revised because it has been temporarily overridden. This could lead to higher fees for builders in the coming year, while the country has to find alternative ways to compensate for these costs. A revision of the judgment was not admitted and the affected counties-Spree-Neiße, Oberspreewald-Lausitz, Havelland and Elbe-Elster-have thus achieved an important stage victory.
