Crash between neighbors: Family in Bonn wins legal dispute over child noise

In a case from Bonn-Bad Godesberg, a heated neighborhood dispute over child noise has ended up before the district court. While a family with two small daughters, which is considered a "screaming child", the child's joie de vivre cannot be taken, a neighbor complained about noise - and not only about the shouting, but also about everyday noises such as clicking light switches and the door. The neighbor then submitted an injunction and asked the parents to reduce the noise. In the worst case, a fine of up to 250,000 euros threatened, such as Berlin Live reported.

The court decided that the parents had to control the noise during the legal rest periods, i.e. between 12 p.m. and 3 p.m. and after 10 p.m. However, the case shows that the German case law is often child -friendly. The Federal Court of Justice explained that "childish behavior that is common in terms of age" and child noise should always be tolerated - even if this often arises. In the event of excessive disorders, however, as in this case, this could lead to serious legal consequences, such as Brisant note.

The family, who has now moved, found a new home in which their children have freedom to play and romp without disturbing neighbors. This incident throws a light on the border areas of the tolerable when it comes to children's noise in rental apartments and illustrates that everyday noises can quickly become an insurmountable dispute.
