Dog noise in Berlin has to be tolerated: court judgment confirms the dog's place in the cityscape

A Berliner has lost in court and has to endure dog noise in her area. The Berlin Administrative Court ruled in a current judgment that the noise emitted by a dog playground is reasonable for residents up to a certain degree.

The applicant had perceived noise pollution as unreasonable and argued that the barking of the dog caused stress and impaired its ability to concentrate. Even with closed windows, relaxation or sleep during the usage -intensive phases should not be considered. However, the court dismissed the lawsuit.

When assessing the reasonableness of noises, the individual adjustment of a possibly particularly sensitive person does not depend, but to the feeling of an average person. In the event of a noise level measurement in the applicant's apartment, the permissible immission guidelines were kept.

It must also be taken into account that dog noise is recurring during the day, but by no means continuous. In addition, dog keeping and dog exits are part of the typical cityscape of a big city. For reasons of animal welfare, it is important to give dogs the opportunity to move freely.

However, it should be noted that dog noise can be harmful to health. Dogs can produce different noises, including barking, yelling and growling. If a dog makes loud noises near the hearing, this can cause temporary or permanent damage to the sensitive structures in the inner ear. Long exposure or regular loud noises can lead to damage.

In terms of dog noise, the experts are not as clear as the Berlin Administrative Court. It is important that dog noise remains within a reasonable framework and consideration of the health of the residents is taken. A respectful handling between dog owners and residents is therefore essential.
