After the escalated pro-Palestinian demonstration at Potsdamer Platz in Berlin on Sunday, there are discussions about the designation of Hamas supporters from Germany. Federal Interior Minister Faeser and Senator of the Interior Spranger supports consistent instructions and deportations of criminals and people who are subject to exit. However, the legal limits for deportations are tight. Expulses and deportations are not punishments, but instruments of immigration law. They are out of the question among German citizens. For foreigners, it is true that there must be a "danger to public security and order" in order to be shown. The crimes must have a certain weight. Violence on demonstrations, serious crimes against life or assault weigh particularly hard. However, it is not enough to only participate in a forbidden demonstration. If someone belongs or actively supports a terrorist organization, expulsions can be made. However, the authorities must present concrete facts that can be checked in court if necessary. Views of hatred and violence can also be a reason for instructions. Deportations are the last remedy if those affected do not leave themselves. However, the prerequisites for deportations in crisis regions are often problematic. If the country of origin does not accept the person who is not accepted or missing papers, deportation cannot be carried out. In Berlin there were 5,436 people who are obliged to leave as of June 30th. 15,261 of them had an official tolerance and 2,175 cases were open. Up to and including July, 762 people were inevitably deported in Berlin this year.
