Law fracture in climate protection: BUND occurs constitutional complaints
The signing of the amended climate protection law (KSG) by Federal President Frank-Walter Steinmeier has caused a sensation and criticism. The Federation for the Environment and Nature Conservation Germany (BUND) raises serious allegations against the federal government and sees it legitimized a break. This continues to push climate protection in Germany to the long bank. The decision of the Federal Constitutional Court of 2021, which demanded a clear obligation to protect climate protection, remains not taken into account.
The weakened climate protection law does not allow Germany to contribute its part to compliance with the 1.5-degree limit binding under international law. The German climate goals are too weak according to scientific standards, which also makes it difficult to achieve this task. The federal government warns that the missed opportunities and the lack of effective measures in current climate policy will lead to tomorrow. In order not to simply accept this breach of law, the federal government, together with the Solaren Energy Förderverein Germany and four individual plants, is a constitutional complaint against the Climate Protection Act.
The constitutional complaint is part of a joint action by five German environmental associations and plaintiffs from all parts of society in order to proceed against the insufficient climate policy of the federal government. In addition to the BUND and the Solarenergie Förderverein Germany, German Environmental Aid (DUH), Greenpeace and Germanwatch have also lodged a complaint. With a pioneering judgment, the Federal Constitutional Court granted the right to climate protection in 2021.
