BGH judgment: Premium savings contracts - those affected can now reclaim money
court ruling on premium savings contracts: As those affected, those affected secure their interest aftermall
In a pioneering judgment, the Federal Court of Justice (BGH) decided today that hundreds of thousands of savers of savings banks and banks have been disadvantaged over the years during their premium savings contracts. The verdict makes it clear that the affected person is entitled to significantly more interest than they have so far been distributed. In recent years, many credit institutions have paid their customers too few interest in premium savings contracts, and in individual cases these were thousands of euros. Finanztip had already pointed out this procedure years ago and started an action alliance together with the Saxony Consumer Center and the Citizens' Movement Financial Movement to increase the pressure on the banks and to make the opaque practices more transparent.
Today's judgment of the BGH is an important step in order to finally give the affected customers certainty and the legal basis for the recovery of their money. The Saxony Consumer Center will continue to appear in this matter and is available to those affected.
However, affected customers should not act over the fall and, above all, refrain from taking on prematurely offered solutions from the banks. As a first step, Finanztip recommends that the consumers concerned ask their bank to recalculate interest rates. Finanztip provides a sample letter that can help.
It is important to note that the claims expire after three years of termination if no measures are taken. For contracts that ended in 2021, the limitation period runs until the end of the year. In such cases, it is advisable to switch on an arbitration board to prevent the limitation period.
Unfortunately, for many older customers, it is unfortunately already too late to reclaim their money they have made, since the claims are statute -barred in the court's opinion.
Today's judgment of the BGH is a great success for affected savers. It shows that the banks can be held responsible for their unethical behavior. It is important that those affected are now actively taking care of their financial interests and reclaiming them to them.
Finanztip will continue to support the Saxons Consumer Center in its commitment and work for consumers' rights. The judgment of the BGH marks an important step in the right direction and should serve as a reminder to the banks to rethink their business practices and make them more transparent. Consumers should perceive their right to fair treatment and insist that the interest they are entitled to.
