In Berlin herrscht weiterhin Chaos und Uneinigkeit über die Umsetzung des Cannabis-Gesetzes. Während andere Bundesländer bereits Anbauvereine genehmigen, diskutieren die Behörden in der Hauptstadt noch über Zuständigkeiten. Weder die Gesundheitsverwaltung noch die Bezirke wollen sich damit befassen. Dies führt zu Verzögerungen und zeigt die Schwächen des Berliner Verwaltungssystems auf. Die Nicht-Umsetzung des Bundesgesetzes ist bedenklich, da die Leute sowieso cannabis konsumieren - sei es vom Schwarzmarkt oder aus Eigenanbau. Eine funktionierende Stadt sieht anders aus.

State failure in Berlin: The hurdles in the implementation of the Cannabis Act

Seven weeks ago, the Bundestag passed the cannabis law, which regulates the cultivation and sales of the plant as a stimulant for adults. However, while cultivation associations are already ready to go in other federal states, in Berlin there is still ambiguity as to which authority will ultimately be responsible and what permits should look like.

This official stilemma clearly shows the failure of the Berlin administration. Instead of setting up a clear contact point and editing the applications, responsibilities will continue to be discussed. Neither health administration nor the districts are willing to take over the implementation of the Federal Law. Even the top conversation with the governing mayor brought no solution. Officially, the districts are still responsible for the implementation, although the mayor sees the State Office for Health and Social Affairs (Lageso).

No matter what defects the cannabis law may have and how well-known the objections to legalization are, it is questionable that the federal states do not implement the federal laws. For political reasons, black-red may block unpleasant law. That would be ethically questionable and senseless. People, including minors, consume cannabis anyway. You don't care whether the marijuana comes from your own balcony or the black market. However, it is even more worrying that the Berlin Senate and the administration again cannot manage bureaucratiochaos.

As long as these grievances continue, Kai Wegner should never speak of a functioning city again. It is time for the Berlin administration to be able to act again and ensure clear responsibilities. The implementation of the Cannabis Act should no longer be delayed to offer people in Berlin a legal alternative to the black market.
