Berlin: Linke calls for personal delivery of eviction laws

The Berlin left has called for evacuation laws to be personally delivered by judicial officers in order to combine offers of help with this delivery and to fundamentally prevent evacuation. This claim is based on a model project that was initiated by the former judicial senator Lena Kreck (left) in 2021.

The left-wing faction in the House of Representatives has already appealed to the new judicial senator Felor Badenberg (independent) to implement this project. However, in the CDU parliamentary group there are concerns about the effort that would be associated with personal delivery. Alexander Herrmann, legal policy spokesman for the CDU parliamentary group, expressed doubts as to whether judicial officers would be able to see and inform the corresponding rental debtors. He emphasized that people in emergencies also have a certain obligation to cooperate.

Background of the discussion is an incident in Berlin-Spandau on Tuesday, in which a special command (SEK) violently entered an apartment for the police to carry out a clearance. Shots fell on the part of the tenant, who then took his own life. He had previously threatened with force and caused a long police operation.

The discussion about the delivery of evacuation laws is a sensitive topic. The Berlin left -wing argues that personal delivery by judicial officers would make it possible to offer the affected tenants of help and prevent evacuation. The CDU parliamentary group, on the other hand, sees the associated effort as not stampable and emphasizes the obligation to cooperate in emergencies.

It remains to be seen how the new Senator for Justice Felor Badenberg will position itself on this topic and whether the model project will ultimately be implemented. Forced evacuation are a complex problem in which various aspects such as social support and legal framework conditions must be taken into account.
